Whistleblower questions Apple’s claim that it does not silence employees

Cher Scarlett, the central organizer of the #AppleToo movement, said that Apple tried to force her to sign a strict non-disclosure agreement after she left the company.

Scarlett was the early founder of the #AppleToo movement, which sought to shed light on alleged racism, sexism, inequality and other issues at Apple. After reaching a settlement with Apple, Scarlett agreed to leave the company and drop the National Labor Relations Committee’s appeal. The complaint is still in the books at the moment.

Shortly after the deal was struck, Apple’s lawyers tried to force Scarlett to sign strict non-disclosure and disparagement clauses as part of the separation agreement. Some of the languages ​​in the contracts outlined exactly what Apple wanted Scarlett to say about his departure: “After 18 months at Apple, I decided it was time to move on and look for other opportunities.”

“In my opinion, I should be able to say whatever I want until I slander Apple,” she said.

The organizer #AppleToo refused to sign the gag account. However, Business Insider reports that it was fresh in her mind when the company made several statements to the Securities and Exchange Commission in October.

In response to a shareholder proposal expressing concern about the use of the NDA “in the context of harassment, discrimination and other illegal acts,” Apple told the SEC not to use such clauses.

However, on October 25, Scarlett filed a complaint with the whistleblower, calling Apple’s statements to the SEC “false statements or deceptive.” She cited her own experience of receiving NDAs from Apple, and along with her whistleblower complaint, she included a copy of the settlement agreement.

On Monday, Nia Impact Capital – a group of activist shareholders who expressed concern to the NDA – told the SEC on Monday that it had “received information, provided confidentially, that Apple had tried to use concealment clauses in the context of discrimination, harassment and other workplace lawsuits.” place. ” Scarlett revealed that she was the source of the information Monday night.

Scarlett’s appeal is the second to be issued in connection with the shareholders ’decision. Back in October, Ashley Gjovik – who was fired in September for allegedly sharing confidential information – also filed a complaint with the SEC.

Apple is in the midst of controversy over employee organization. While the notorious secret company condemned the recent press leaks, Apple issued a letter earlier in November confirming the right of employees to openly discuss salaries and working conditions.
