If you are a US-based TikTok user, you may have received this warning in the app over the past week.
Which looks weird, even on a scam, right?
It’s not a scam, it’s actually related to this legal complaint in northern Illinois County, through which TikTok is facing a class action lawsuit for collecting and using user data.
According to the initial settlement agreement (reported through Mashable):
“Prosecutors allege that the TikTok app infiltrates its users’ devices and extracts a wide range of private data including biometrics and content that defendants use to track and profile TikTok users for, among other things, ad targeting and earnings. ”
TikTok has denied violating any state or federal law in its proceedings, but instead of going to trial, it has agreed to a settlement, which, if approved, will be seen by all U.S. TikTok and Musical.ly users, who have signed up for application by September 30, 2021, are eligible for a fee, if they decide to take it over.
TikTok’s parent company, ByteDance, has also agreed to bring in third-party experts to oversee employee data privacy training and to avoid collecting biometric and location data from users.
Given the complexity of the game, ByteDance has a good chance of really winning the case if the trial is over, which is why the plaintiffs ’legal team suggested that reaching a settlement might be the best way forward.
So how much will you get? Probably not much.
The settlement is currently proposed in the amount of 92 million dollars, without the costs of lawyers and additional costs. TikTok had more than 100 million U.S. users in August 2020, so if all of its users signed up to invest their cash rights, you would look at a payment of well under $ 1 per user.
But not everyone will sign up, so you might be able to get a couple of dollars out of it, if, indeed, the settlement is approved.
The following options are available to take action:
You can make a claim on your own behalf or on behalf of your child (ren), but if you do nothing or opt out, you are not entitled to any part of the settlement – again, if it is approved.
As for the wider use of the data, TikTok continues to face various investigations and inquiries in this area, especially regarding its ties with the Chinese government, but it seems that this particular case will be resolved, in order to avoid further legal challenges.
